Policy and Agreement

This SCHOOL POLICY AND AGREEMENT (“School Policy”) is made by and between Clarity Music School (“School”), the assigned Teacher (“Teacher”) and the party/ies (i.e. parents, guardians and/or students referred to as:“Student”).

LESSON CANCELLATION POLICY

  1. Cancellation of a lesson must be made AT LEAST 24 hours prior to the scheduled lesson time in order to receive a make-up lesson (for definition of a make-up lesson, please see below).  This includes leaving messages on the answering machine or eMail.
  2. No shows or failure to notify the school/teacher within 24 hours is considered a forfeited lesson. No refunds, credits or make-up classes are given for a forfeited lesson.
  3. No more than 2 cancellations per set of 12 lessons.
  4. If you know of dates ahead of time where you/your child cannot make a lesson, please notify the school when booking/paying for your lessons.
  5. There are NO refunds on unused or cancelled lessons.
  6. Should you choose to take a break, unused lessons can be banked for you for a period of 3 months.  Unused lessons after that time will be considered forfeited.
  7. Cancellation of study in the school requires a 2-lesson notice unless otherwise agreed upon. Payment for and/or completion of 2 lessons must be made after notification of intent to quit has been made.

MAKE UP LESSONS

  1. Any lessons cancelled at least 24 hours ahead of the scheduled lesson will receive a make-up lesson at a time convenient to both the teacher and the student.  This makeup lesson will not be skipped over or added to the end of the set of 5 lessons.
  2. Typically, make-up lessons take place at an alternate time/day within the week.  In some cases, the make-up lesson will be added after/before the original lesson time, enabling the student to have an hour lesson.
  3.  Make-up lessons not used after 3 months will be considered forfeited.
  4.  A make-up lesson needs to be booked with  the school scheduler.

TARDY ARRIVAL

Please notify the scheduler if you will be more than five minutes late; it is your paid time. If you are more than 10-minutes late, the lesson is counted as a late cancellation with no make-up lesson given.


HOLIDAYS / SCHOOL BREAKS

Exceptions will be made with respect to School breaks, Christmas, March Break, Religious and Statutory Holidays.  Those weeks will be skipped over during the consecutive weekly lessons. Please advise school scheduler as soon as you know you will have to miss a lesson due to these previously mentioned breaks. 


WHEN YOUR TEACHER CANCELS

In most cases, when your teacher cannot be here, we will find a suitable substitute teacher and the lesson will continue as regularly scheduled.   If your teacher cancels a lesson and we are unable to find a substitute teacher, we will skip over that weeks lesson and resume the following week.  All payments will be pushed forward to compensate for the missed lesson.


STUDENT CARE

Parents or legal guardians of underage students are requested to not leave the student at the school for excessive times before or after class. I waive legal action for any injury sustained by the student at the school through normal activities. The school is granted permission to take photographs of students to use in brochures, web sites, posters, ads, and other promotional materials it creates, and to copyright such photographs in its name. Student names will not be used in promos.


MEDIA CONSENT

Parent and/or Student hereby consents to and authorizes the School to capture and use video-audio recordings and photographic images of Student and Student’s musical performances and quoted statements in print, electronic, or online media, for educational and School promotional purposes only, without any compensation to Parent or Student. Parent and/or Student agrees to waive and release any and all claims Parent may have against School relating to the use of these recordings, images, or statements. This Consent is binding upon all heirs and future legal representatives. School will not personally identify a minor child by full name in connection with a video recording or photographic image of the child, unless School receives separate written signed consent from the Parent.


DISPUTE RESOLUTION

In the event of any dispute, claim, or disagreement (“Dispute”) arising from this School Policy and Agreement, the parties shall use their best efforts to settle the Dispute. To this effect, the parties shall consult and negotiate with each other in good faith, and recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. If the parties do not reach such solution within a period of sixty (60) days, then upon notice by either party to the other, all Disputes shall be finally settled by arbitration administered by the American Arbitration Association in accordance with the provisions of its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered into any court having jurisdiction thereof.


SEVERABILITY

If any term or provision of this School Policy and Agreement is illegal or invalid for any reason, such provision is severable from the rest and shall not affect the legality or validity of the remainder of this School Policy and Agreement.


WAIVER OF LIABILITY; INDEMNIFICATION

PARENT AND STUDENT HEREBY WAIVES, RELEASES, DISCHARGES, AND COVENANTS NOT TO SCHOOL, ITS OWNERS, EMPLOYEES, AGENTS OR REPRESENTATIVES (“RELEASEES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ARISING OUT OF, OR RELATED TO, STUDENT’S PARTICIPATION IN SCHOOL ON-SITE OR OFF-SITE LESSONS, EVENTS, OR ACTIVITES (“SCHOOL PROGRAMS”), WHETHER BASED IN CONTRACT OR TORT.
PARENT AND STUDENT AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASEES FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, ATTORNEY’S FEES, COSTS, LIABILITIES, OR DAMAGES AGAINST SCHOOL ARISING OUT OF STUDENT’S PARTICIPATION IN SCHOOL PROGRAMS.

BY PURCHASING LESSONS FROM ClARITY MUSIC SCHOOL , YOU HAVE CONFIRMED THAT YOU HAVE READ THIS SCHOOL POLICY AND AGREEMENT, AND FULLY UNDERSTANDS AND AGREES WITH ITS TERMS, CONDITIONS, AND PROVISIONS.
